Limelight Magazine meldt daarover: https://limelightmagazine.com.au/news/c ... gh-courts/

Circus Oz backflips, will continue with new board, as sexual harassment charges proceed through courts

After an Extraordinary General Meeting the company will move forward with a new board, but serious issues still need to be resolved.

Circus Oz has announced that it will not be shut down, and will continue to operate with a brand new board.

The previous board had announced in December that it would dissolve the company, after it determined that a potential loss of funding from the Australia Council would force the company to fundamentally change how it operates.

That determination was based on an independent review, commissioned in conjunction with the Australia Council and Creative Victoria, which identified that there were systemic issues holding back the company, and recommended reforms to introduce an entirely skills-based board and broaden the membership criteria to diversify representation.

Those reforms were put to a vote of the company’s members, the results of which demonstrated the reforms were not supported by the membership. As such, the former board made the decision to wind up the company.

However at an Extraordinary General Meeting on 16 February that decision, and the board itself, was roundly rejected by those same Company Members, and a new board of directors – comprised of Chad Albinger, Regina Hill, Bryce Menzies and John Paxinos – elected to secure the company’s future.

The new Circus Oz board is a mix of experienced arts practitioners, lawyers and philanthropists:

Chad Albinger is an experienced production and performance rigger, props designer, furniture designer and fabricator, who has a long history with Circus Oz including as an onstage performer. He has previously acted as a member-elected Board Member.

Regina Hill is the Managing Director of Regina Hill Effective Consulting Pty Ltd and Effective Philanthropy, and has worked as a consultant for over 15 years. She was previously the Chair of the Women’s Circus.

Bryce Menzies has worked in entertainment law since 1984, and is currently a partner and head of the entertainment department at marshalls+dent+wilmoth lawyers.
He has extensive experience especially in film, and has also served as Chair of Melbourne International Film Festival Limited among numerous other governance roles.

John Paxinos is a specialist in the financial viability of arts organisations, and began his career in arts management when he was appointed General Manager of the Murray River Performing Group and Flying Fruit Fly Circus in Albury-Wodonga in 1980.

In a statement issued following the Extraordinary General Meeting, Circus Oz said it has a proud history and a strong reputation both in Australia and overseas, and remains committed to the values that have underpinned the company since its establishment in 1977.

The board has a number of challenges that it will need to address immediately, most pressingly the financial future of the company.
The potential loss of Australia Council funding remains a very real existential threat, and it is not known how long the company could remain viable without it.
The board will also have to make a decision about whether to reopen the company’s Melbourne offices, which are managed by Creative Victoria and owned by the Victorian state government.

Another major issue facing the company is a claim of historical sexual harassment that is proceeding through the Victorian courts.
As reported in Lawyerly on 11 February, Judith Lanigan, a freelance circus performer, brought a suit against Circus Oz in 2018 alleging sexual harassment against Matt Wilson, a Circus Oz employee and later board member.

Lanigan also claims that she was blacklisted by Wilson in regards to future employment with the company, and more broadly in the Australian circus industry, after she first aired these allegations in a fictionalised form in her 2009 book A True History of the Hula Hoop.
She alleges that the company blacklisted her from 2010 to 2016, and again in 2017.
